Welcome to Jojo Health, Inc. (“Jojo Health”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our website (https://jojo.health), our Jojo companion robot, any associated mobile or web applications, and our SMS alert services (collectively, the “Services”).

By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Use of Our Services

You may use our Services only if you are at least 18 years old and capable of entering into a binding agreement. You agree to use the Services only for lawful purposes and in accordance with these Terms.

2. Account Registration

Certain Services may require account registration. When you register, you agree to provide accurate and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials.

3. SMS Notification Terms (A2P 10DLC-Compliant)

When setting up the Jojo companion robot, designated individuals may choose to receive SMS text message alerts. By providing your mobile number and affirmatively opting in, you agree to the following:

A. Message Content

You may receive SMS messages that include:

  • Notable health-related events detected by the system
  • Audio transcript summaries of predefined spoken prompts

All messages are strictly informational and do not contain Protected Health Information (PHI).

B. Opt-In Process

You opt-in by:

  • Entering your mobile number during robot setup at https://jojo.health/sms-consent
  • Checking a box that states: “I consent to receive SMS notifications from Jojo Health, Inc. regarding the individual for whom I am listed as a designated contact. These messages include alerts about potential irregularities in their speech patterns, which may indicate a medical concern. I understand that message and data rates may apply, and that I can reply STOP to opt out at any time. I have reviewed the Privacy Policy and Terms of Use.”

Only designated individuals may enroll. You must be at least 18 years old to participate.

C. Message Frequency & Charges

Message frequency varies depending on system activity. Standard message and data rates may apply. Check with your carrier for details.

D. Opt-Out Instructions

You can opt out at any time by replying STOP to any SMS from us. After opting out, you will no longer receive messages unless you re-enroll.

E. Help

For help, reply HELP to any SMS or email us at support@jojo.health.

F. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

4. Intellectual Property

All content, trademarks, designs, and software associated with the Services are owned by Jojo Health or its licensors. You may not copy, distribute, or create derivative works without our prior written consent.

5. User Conduct

You agree not to:

  • Interfere with the operation or security of the Services
  • Attempt to access data not intended for you
  • Use the Services for any fraudulent or unlawful purpose

6. Third-Party Services

Our Services may link to or integrate with third-party services. We do not control and are not responsible for those services or their content, terms, or privacy practices.

7. Disclaimers

Our Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Jojo Health shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.

9. Indemnification

You agree to indemnify and hold harmless Jojo Health and its affiliates, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

10. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

11. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting them on our website. Your continued use of the Services after changes are posted constitutes your acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
